New York Driving Schools: Licensing and 5-Hour Course Approval
How New York driving schools get licensed, how instructors earn and renew the MV-524 certificate, and how schools become 5-hour course providers.
New York driving schools are licensed by the DMV under Vehicle and Traffic Law section 394. To open one, you apply online, pay a $50 application fee and a $50 license fee, and show an approved office, listed training vehicles and a certified instructor with at least 1,000 hours of behind-the-wheel experience. Each instructor then needs their own DMV certificate (the MV-524), and schools that want to teach the 5-hour pre-licensing course need classroom-endorsed instructors and an approved classroom.
Key takeaways
- State law says no one may engage in the business of conducting a drivers' school without a DMV license.
- The school office must be at least 1,500 feet from a DMV road test post and from government buildings that issue licenses or registrations.
- Instructors must be 21, take a 30-hour course, pass four tests and work for a licensed school.
- To teach the 5-hour course, instructors need a classroom endorsement and the school files an MV-278.6 signature list.
Opening a driving school in New York
The DMV's open a driving school page lays out the steps.
1. Pick a name the DMV will accept
Your business name can't be the same as, or too similar to, a school name licensed or approved in the last 5 years. It can't imply DMV endorsement or mislead customers. The DMV keeps a list of prohibited names.
2. Set up the business
Choose a legal structure, get an Employer Identification Number, file a business certificate or corporate filing, and arrange insurance and employee coverage.
3. Find a qualifying office
New York's location rules are strict:
- At least 1,500 feet from a state- or county-owned building where registrations or licenses are issued, and from a DMV road test post
- At least 50 square feet, with secure storage for records and DMV materials
- In cities of 250,000 or more, in a building space used only for nonresidential purposes
- Open to the public at stated hours and accessible to people with disabilities
- Physically separated (partitions are enough) if shared with another business
The statute applies the 1,500-foot rule in cities of 50,000 or more.
4. Apply
The online Application for Original Driving School License is signed by all owners and includes:
- An Abstract of Lifetime Driving Record for the owner or principal, no more than 30 days old
- Your business certificate or corporate filing receipt
- Proof of workers' compensation and disability benefits insurance (or form CE-200 if you have no employees)
- A Personal History Form (MV-521.1)
- A lease and Certificate of Occupancy
- A certified instructor with at least 1,000 hours of behind-the-wheel instruction experience
- Sample records: a ledger, customer information, and receipts or contracts
- A list of training and testing vehicles on form MV-527
Fees are a $50 application fee and a $50 license fee. On paper, that's two separate checks or money orders to the Commissioner of Motor Vehicles.
5. Post the required notices
Display your license, a price list for all services, and a sign stating "Applicant must be given a receipt for all payments."
License renewal
Under section 394, renewal is $50 for one year or $100 for two years, and the commissioner may issue a license for up to two years on renewal.
Instructor certificates (MV-524)
Every instructor needs a Driving School Instructor Certificate. Requirements include:
- Employment by a DMV-licensed driving school
- Age 21 or older
- A New York-valid license held at least 2 years in the class you'll teach, not suspended or revoked in the last 2 years, with an acceptable record
- A high school diploma or equivalency
- No felony convictions or convictions for crimes involving violence, dishonesty or similar offenses
- The 30-hour Methods and Content Course for In-Car Instruction (MCCII) from an approved community college or driving school
Applicants pass a vision test, a road sign test, a written test (two attempts each per application) and a behind-the-wheel instructor's driving test (one attempt, in a car you provide). A school official files the application online. The DMV mails the MV-524 to the school.
The certificate covers only the school named on it. Carry it while teaching and at road test sites. For other states, see How to Become a Driving Instructor: Requirements by State.
Renewing an instructor certificate
An original certificate expires on the last day of the 12th month after issue, and renewals are valid for two years. The DMV's renewal page lists:
- $20 for a two-year renewal (out-of-state license holders renew for one year only)
- Fewer than 7 points and fewer than 3 reportable crashes in the last 24 months
- No suspension or revocation in the past two years, except temporary suspensions
- Proof of the 30-hour MCCII at first renewal (owners can request a one-time, one-year waiver)
Becoming a 5-hour pre-licensing course provider
The Classroom Pre-Licensing Course is known as the "5-hour classroom course." Commercial driving schools can offer it along with high schools, colleges and other DMV-approved sites.
What a driving school needs:
- Classroom-endorsed instructors. Only approved classroom instructors may teach the course. The instructor page says that requires a 30-hour Teaching Techniques and Methodology course and at least 1 year as a behind-the-wheel certified instructor.
- An approved classroom. At least 150 square feet, with 15 square feet per student, and at least 200 square feet combined with the office. It must be clean, accessible, well lit and free of distractions (source).
- The MV-278.6 Authorized Signature List, submitted with the driving school application, naming who can request and issue course completion certificates.
- The DMV curriculum. Teach from the Pre-Licensing Course Instructor's Manual (MV-277); students can use the MV-277.1 manual.
- Compliance with Part 7 of the Commissioner's Regulations (CR-7).
Students who finish receive a pre-licensing course completion certificate (MV-278). Those certificates matter, so handle them carefully. See Why Your Driving School Certificate Matters (and How Insurers Verify It).
